You are responsible for safeguarding your password and account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.

4. User Content and Intellectual Property

You retain all ownership rights to the images and content you upload to our Platform ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing and improving our Service.

4.2 Content Responsibilities

You represent and warrant that:

• You own or have the necessary rights to upload and use your User Content
• Your User Content does not infringe on any third-party rights
• Your User Content does not contain illegal, offensive, or inappropriate material
• You have obtained all necessary permissions for images of properties and people

4.3 Generated Content

Images generated or enhanced by our AI services are provided to you for your use. While you may use these generated images for your business purposes, we retain the right to use anonymized, aggregated data from the generation process to improve our Service.

4.4 Our Intellectual Property

The Service, including its original content, features, functionality, and underlying technology, is owned by Imagined Home and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our Service without our express permission.

The quality of AI-generated images may vary, and we do not guarantee specific results. You are responsible for reviewing and approving all generated content before using it for business purposes.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMAGINED HOME AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors or omissions in content or any loss or damage incurred from use of content
• User Content or the defamatory, offensive, or illegal conduct of any third party

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Imagined Home and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease, and we may delete your account and data.

14. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Imagined Home operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority, except where prohibited by law. You agree to waive any right to a jury trial or to participate in a class action lawsuit.
